Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of WatchTower Terminal and its related websites and applications (the "Platform"), operated by EliteTraders LLC ("we", "us", "our"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Platform. By using it, you represent that you meet these requirements and that any information you provide is accurate and complete.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Authentication and account management are handled through a third-party provider. Notify us promptly of any unauthorised use. We may suspend or terminate accounts that violate these Terms.

4. Subscriptions and billing

The Platform offers a free tier and a paid "Pro" subscription. Paid subscriptions are billed in advance on a recurring basis (currently $49 per month) through our third-party payment processor, Stripe. By subscribing, you authorise us to charge your payment method on each renewal until you cancel. Prices may change; we will give reasonable notice of any change, which will apply from your next billing cycle. Cancellation and refund terms are set out in our Cancellation & Refunds policy.

5. Nature of the service, not financial advice

The Platform is an educational and research tool. It does not provide financial, investment or trading advice, recommendations or signals, and no fiduciary or advisory relationship is created. You are solely responsible for your own decisions and outcomes. Please read our Disclaimer, which forms part of these Terms.

6. Acceptable use

You agree not to: (a) resell, redistribute, scrape, or commercially exploit the Platform or its content without our written permission; (b) share your account or access credentials with others; (c) attempt to gain unauthorised access to the Platform, interfere with its operation, or circumvent access or usage limits; (d) use the Platform in violation of any applicable law or third-party rights; or (e) use automated means to extract data except as expressly permitted.

7. Intellectual property

The Platform, including its design, software, scoring methodology, compiled data, text and graphics, is owned by EliteTraders LLC or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your own personal or internal business use in accordance with these Terms. Third-party research and trademarks remain the property of their respective owners.

8. Third-party content and services

The Platform incorporates data, research and services from third parties. We are not responsible for the accuracy, availability or content of third-party materials, and their inclusion does not imply endorsement or affiliation unless expressly stated.

9. Disclaimers and limitation of liability

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including as to accuracy, availability, merchantability or fitness for a particular purpose. To the fullest extent permitted by law, EliteTraders LLC shall not be liable for any indirect, incidental, special, consequential or exemplary damages, or any trading losses, arising from your use of the Platform. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

You may stop using the Platform and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or where required by law. Provisions that by their nature should survive termination will survive.

11. Changes to these terms

We may update these Terms from time to time. Material changes will be notified through the Platform or by email, and continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-laws rules, and the courts of that jurisdiction shall have exclusive jurisdiction over any dispute, subject to any mandatory consumer-protection rights you may have.
